Face Value — Terms & Privacy

NOTICE: Please read these Terms carefully. They cover important information about the Face Value web application provided to you. These Terms include information about future changes to these Terms, limitations of liability, a class action waiver, and resolution of disputes by arbitration instead of in court.

PLEASE NOTE THAT YOUR USE OF AND ACCESS TO FACE VALUE (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE FACE VALUE IN ANY MANNER.

Welcome to Face Value

Please read on to learn the rules and restrictions that govern your use of the Face Value web application (the “Application” or “Face Value”). If you have any questions, comments, or concerns regarding these terms or Face Value, please contact us using the contact information provided at the bottom of this page.

These Terms of Use (the “Terms”) are a binding contract between you and Geshido Corporation (“Geshido,” “we” and “us”). You must agree to and accept all of the Terms, or you don’t have the right to use Face Value. Your using Face Value in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use Face Value. These Terms include the provisions in this document, as well as those in the Privacy Policy.

What is Face Value?

Face Value is a client-side web application that helps users align their face with a webcam. It uses on-device face detection to provide real-time guidance through spoken announcements or screen-reader-compatible text, assisting users in achieving proper camera alignment. Face Value runs entirely in your browser — no data is sent to Geshido servers.

Will these terms ever change?

We are constantly trying to improve Face Value, so these Terms may need to change along with the Application. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on our website and/or by some other means.

If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use Face Value. If you use Face Value in any way after a change to the Terms is effective, that means you agree to all of the changes.

Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and agreed to by both you and us.

What about my privacy?

Geshido takes the privacy of its users very seriously. Please review our Privacy Policy for more information on how your data may be used and stored due to your use of the Application.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to use Face Value or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at support@geshido.com.

What are the basics of using Face Value?

Face Value is a client-side web application that does not require you to create an account with Geshido. The Application operates entirely in your browser.

You represent and warrant that if you are an individual, you are of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and gotten your parent or guardian to agree to these Terms on your behalf).

You will only use Face Value for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of Face Value is prohibited by applicable laws, then you aren’t authorized to use Face Value. We can’t and won’t be responsible for your using Face Value in a way that breaks the law.

Your use of Face Value is subject to the following additional restrictions:

You represent, warrant, and agree that you will not use Face Value in a manner that:

• Infringes or violates the intellectual property rights or any other rights of anyone else (including Geshido)
• Violates any law or regulation, including, without limitation, any applicable export control laws
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Violates the security of any computer network, or cracks any passwords or security encryption codes
• Interferes with the proper working of Face Value
• Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to Face Value

A violation of any of the foregoing is grounds for requesting that you cease using Face Value.

What are my rights in Face Value?

You understand that Geshido owns Face Value. You won’t modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, or otherwise exploit Face Value without prior permission from Geshido.

All settings and configuration data that you create in Face Value remains your data.

License Grant and Restrictions

Grant of License: Subject to your compliance with these Terms, Geshido Corporation grants you a limited, non-exclusive, non-transferable, revocable license to access and use Face Value for your individual use.

Current Free Use: Face Value is currently available at no charge. Geshido reserves the right to require a paid license for continued use of Face Value at any time in the future. If Geshido decides to require payment, notice will be provided either through updates to these Terms of Use or through a notice on the Face Value website.

Non-Transferable and Non-Shareable: Your license to use Face Value is personal to you as an individual and may not be transferred, assigned, shared, sold, or otherwise conveyed to any other person or entity.

License Revocation: Geshido reserves the right to revoke your license at any time if you breach these Terms or misuse Face Value.

Data storage and management

Face Value stores your settings data in your browser’s local storage in accordance with the terms of its Privacy Policy. The integrity and privacy of your data depends on your browser functioning according to specifications. Geshido is not responsible for any issues caused by browser malfunctions or deviations from expected behavior.

You may clear your locally stored data at any time using your browser’s built-in storage controls.

Camera access

Face Value requires access to your device’s camera to provide face alignment guidance. Camera access is requested through your browser’s standard permission system. Video from your camera is processed entirely on your device — it is never transmitted to Geshido or any third party. You may revoke camera access at any time through your browser’s permission settings.

Third-party dependencies and limitations

Face Value uses Google’s MediaPipe library for on-device face detection. MediaPipe model files are loaded from Google’s content delivery network when you use Face Value. Your use of MediaPipe is subject to Google’s terms. Geshido is not responsible for the availability or operation of third-party libraries or content delivery networks.

Face Value is hosted on Netlify. Geshido is not responsible for the operation of the hosting platform. Your access to Face Value may be subject to Netlify’s terms of service and privacy practices (see our Privacy Policy for more details).

If there is a dispute between you and any third party (including Google, Netlify, your employer, or system administrators), you agree that Geshido is under no obligation to become involved. You release Geshido, its directors, officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or Face Value. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

Will Geshido ever change Face Value?

We’re always trying to improve Face Value, so it may change over time. We may introduce new features, modify existing features, or discontinue Face Value entirely. We reserve the right to make these changes at any time, in our sole discretion, and without prior notice.

Does Face Value cost anything?

Face Value is currently available at no charge. You may use Face Value without any payment requirements.

Geshido reserves the right to require a paid license for continued use of Face Value at any time in the future. We may also introduce additional paid features or premium tiers. If we decide to require payment for Face Value, we will provide notice through updates to these Terms of Use and/or through a notice on the Face Value website.

What if I want to stop using Face Value?

You’re free to stop using Face Value at any time by simply closing the page or navigating away. Face Value stores settings data only in your browser’s local storage. You can clear this data at any time using your browser’s built-in storage controls.

Geshido may also request that you cease using Face Value for any reason in our discretion, including your breach of these Terms.

Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us, including without limitation the arbitration agreement.

What else do I need to know?

Warranty disclaimer

Geshido provides Face Value “AS IS” without warranty of any kind. We make no representations or warranties concerning Face Value, and we will not be responsible or liable for the accuracy, reliability, or functionality of Face Value, including the accuracy of face detection or alignment guidance. FACE VALUE IS PROVIDED BY GESHIDO ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF FACE VALUE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Accessibility disclaimer

While we strive to make Face Value accessible and may reference accessibility features in our marketing materials, such references do not create any legal obligation or guarantee to accommodate any particular person, disability, or accessibility need. Any accessibility features are provided on a good faith, best effort basis.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL GESHIDO (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO GESHIDO FOR FACE VALUE IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR © ANY MATTER BEYOND OUR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO BROWSER MALFUNCTIONS OR BROWSER DEVIATIONS FROM EXPECTED SPECIFICATIONS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.

Indemnity

To the fullest extent allowed by applicable law, you agree to indemnify and hold Geshido, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to (a) your use of Face Value, and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”), we will attempt to provide notice of the Claim to the contact information we have for you (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder).

Assignment

You may not assign, delegate or transfer these Terms or your rights or obligations hereunder in any way (by operation of law or otherwise) without Geshido’s prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.

Choice of law

These Terms, and any disputes arising out of or related hereto, are governed by and will be construed under applicable federal law and the laws of the State of California, without regard to the conflicts of laws provisions thereof.

Each party hereby agrees that any judicial proceeding will be brought in the state or federal courts located in, respectively, San Mateo County, California, or the Northern District of California.

Each party hereby consents and submits to the exclusive jurisdiction of such courts. In any action or proceeding to enforce rights under the Terms, the prevailing party will be entitled to recover its reasonable costs and attorney’s fees.

Entire agreement

The Terms, including the Privacy Policy and any terms incorporated by reference into the Terms, constitute the entire agreement between you and us and supersede all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter. To the extent of any conflict or inconsistency between the provisions in these Terms and any pages referenced in these Terms, the terms of these Terms will first prevail.

Miscellaneous

You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with Face Value, provided that Geshido may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and Geshido agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Geshido, and that these Terms supersede and cancel all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Geshido, and you do not have any authority of any kind to bind Geshido in any respect whatsoever.

We take your privacy seriously. Face Value is designed with privacy as a core principle. This Privacy Policy explains how Face Value handles your data and information.

What this privacy policy covers

This Privacy Policy covers how Face Value treats data when you use the web application. Face Value is designed to operate entirely in your browser with minimal data handling by Geshido Corporation (hereafter “Geshido”).

Data collection and storage

What we do NOT collect

Face Value does not collect any personally identifiable information (PII). Specifically:

• We do not collect any personal information or identifiable data
• We do not collect your browsing history or user credentials
• We do not use cookies, web beacons, or any tracking technologies
• We do not access, store, or transmit any camera data — all video processing happens entirely on your device

Basic usage data

Geshido reserves the right to collect basic, anonymous usage data such as page load counts. This data contains no personally identifiable information and is used solely to understand general usage levels. No individual user behavior is tracked or profiled.

How your data is stored

Face Value is designed to keep all your data local and private:

• Local storage only: Face Value stores your settings and preferences in your browser’s local storage (localStorage). This data never leaves your device and is never transmitted to Geshido’s servers
• Camera data stays on-device: Video from your camera is processed entirely in your browser using on-device face detection. Camera data is never recorded, stored, or transmitted
• User control: You can clear all stored settings at any time using your browser’s built-in storage controls (e.g., clearing site data). Geshido does not provide a remote mechanism to clear this data — it is entirely under your control
• No external transmission of user data: Your settings, camera data, and usage patterns are never transmitted to Geshido or any third party

Data you may choose to share

The only data Geshido may receive is information you voluntarily choose to share:

• Optional log sharing: If you experience issues with Face Value, you may choose to share logs or diagnostic information with Geshido for support purposes
• Your responsibility: If you choose to share logs, you are responsible for reviewing and redacting any sensitive information before sharing
• Support only: Any information you share is used solely for providing support and improving Face Value

Third-party services

Hosting platform

Face Value is hosted on Netlify. When you access Face Value, Netlify may automatically collect certain technical information as part of serving the web page, such as your IP address, browser type, and access timestamps. This data collection is governed by Netlify’s privacy policy and is outside of Geshido’s control. Geshido does not direct Netlify to collect this information and does not use it for tracking or profiling.

MediaPipe (Google)

Face Value uses Google’s MediaPipe library for on-device face detection. When you use Face Value, MediaPipe model files are downloaded from Google’s content delivery network (CDN). This download may expose your IP address and basic request metadata to Google. The face detection itself runs entirely on your device — no camera data or detection results are sent to Google. Google’s handling of CDN request data is governed by their own privacy policies.

Data security

Since Face Value processes all data locally in your browser, your data security depends on your browser’s security and your device’s security. We recommend keeping your browser and operating system updated. Camera data exists only in your browser’s memory during use and is not persisted. Geshido is not responsible for any issues caused by browser malfunctions or deviations from expected data handling behavior.

Children’s privacy

We do not knowingly collect or solicit personal information from children under 13. If you are a child under 13, please do not attempt to use Face Value or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible.

Your rights and choices

Since Face Value does not collect personal data, traditional data rights (like access, deletion, or portability) are not applicable in the usual sense. However:

• You can stop using Face Value at any time by closing the page
• You can clear all locally stored settings at any time using your browser’s built-in storage controls
• You can revoke camera access at any time through your browser’s permission settings
• You control what, if any, information you choose to share with us for support

Changes to this privacy policy

We may update this Privacy Policy from time to time. If we make changes, we will notify you by posting a notice on our website. Your continued use of Face Value after any changes constitutes your acceptance of the new Privacy Policy.
